To the Honorable, the Civil District Court for thge Parish of Orleans.
The petition of Catherine Lawton, wife of Jerimiah B Colliins, herein aided, authorized and assisted by her said husband; of Margaret Lawton, widow of Patrick A Joyes; and of Peter S Lawton, all of age and residents of this city, with respect represent:That petitioners' mother, Mrs Margaret Gumbleton, widow of James Lawton, departed this life, at her domicile, in this city, on the 24th day of November AD1908, as will appear from the annexed affidavit; that she died intestate, leaving as her sole and only heirs, petitioners, her children, born of her marriage with the late James Lawton; that she left certain property situated within the jurisdiction of this Honorable Court, consisting exclusively of the following described real property, to wit:
Three certain adjoining tracts of land, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes and appurtenances thereunto belonging, or, in any wise appertaining, situated in Tunisburg, on the right bank of the Mississippi River, in this Parish and measuring as follows, to-wit:
First:- One hundred and sixty-fife feet (165'), more or less, front on the Public Road; two hundred and five feet (205'), more or less, in depth and front on London Street; two hundred and eighty feet (280'), more or less, in depth on the line, which separates the property formerly owned by Joachin Robira; and one hundred and forty-seven feet, one inch (147' 1"), on the line of other property, formerly belonging to said Robira.
Second:- Six certain lots of ground, adjoining the above and designated by the numbers 13-14-15-16-17-18 in the same square as the above, which is bounded by London, Orleans, and Newton Streets and the Public Road, according to a plan, drawn by Giroux & Castaing, on the 31st of December AD1850 and in the record of J Cuvillier, late a Notary Public, in this city; said lots measure each, in American Measure. Twenty-nine feet, five inches (29' 5") front on Newton Street, by one hundred and fifteen feet (115') in depth between parallel lines; lot No.18 forming the corner of Newton and London Streets.
Third:- A certain other piece or portion of ground, in the same square and adjoining the above and measuring one hundred and twenty-seven feet (127') more or less, front on the Public Road, by three hundred and fifty feet (350') in depth between parallel lines. Acquired December 1st AD1891, COB129 Folio 385. Petitioners further represent that their said mother never adopted anybody; that her estate is entirely free from debt, worth less than ten thousand dollars, and has borne its just proportion of taxes; and that they desire to accept her succession purely, simply and unconditionally.
Wherefore the annexed premises and annexed affidavit of death and depositions being considered, petitioners pray that they may be recognized as the sole and only heirs, at law of the deceased, and that , as such, they may be sent and put in possession of all the property left by her, consisting exclusively of the real estate herinabove described. On the petition of the children and sole heirs to be recognized and to be put in possession of the estate of their deceased mother, the law and the evidence being in their favor; It is ordered, adjudged and decreed that the petitioners Catherine Lawton, wife of Jeremiah B. Collins; Margaret Lawton, widow of Patrick A Joyes; and Peter S Lawton be and they are hereby recognized as the sole heirs at law of their deceased mother, Mrs Margaret Gumbleton, widow of James Lawton, and that, as such, they may be sent and put in possession of all the property left by her, consisting of the folloing described real property, to-wit:Three certain adjoining tracts of land, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes and appurtenances thereunto belonging, or, in any wise appertaining, situated in Tunisburg, on the right bank of the Mississippi River, in this Parish and measuring as follows, to-wit:
